For posting the gruesome accident scene graphic photos of Nikki Catsouras, a teenager that died in 2006 off a car crash, a Californian appeals court permitted the victim’s family to sue against two CHP officials. The Santa Ana Court of Appeal in 4th District made the groundbreaking ruling earlier this week.

In a fatal accident in the year 2006 Niki Catsouras had died while 18 years of age on the Halloween night. Many of their friends for two numbers officials from the California Highway Patrol had been delivered some graphic accident-scene snapshots of the poor victim as Halloween gifts. The family was shocked to learn about the fact that their daughter’s pictures were made public.

Reversing a lower court’s lawsuit dismissal, the Santa Ana 4th District Appeal Court has given Nikki’s family all the right in the world to sue against the culprits. According to the court’s ruling, “the persons responsible for the act are liable to answer victim’s family’s claims following photos of Nikki speckled about the Wire.” Further, the court ruling went on to state “that proved to be a pure shock value for the family to see the pictures of the diseased girl carrying along hateful remarks.”

The behavior of the two CHP Officials was described as “morally deficient” by Justice Richard Aronson that ultimately revived the privacy claims brought before the court by the family. He further held responsible Aaron Reich and Thomas O’Donnell for sending their friends as well as their own families as many as nine of the photos through e-mails, and the same were spread all over the Internet later.”

Reportedly, the photos in question were posted back to the family even from United Kingdom and some of the remarks they carried were really heartbreaking for them.
